A Western Judge Cites The Koran
Mar 22, 2007
He beat her and threatened her with murder. But because husband and wife were both from Morocco, a German divorce court judge saw no cause for alarm. It's a religion thing, she argued.
Insanity in full force:
The judge rejected the application for a speedy divorce by referring to a passage in the Koran that some have controversially interpreted to mean that a husband can beat his wife. It's a supposed right which is the subject of intense debate among Muslim scholars and clerics alike."The exercise of the right to castigate does not fulfill the hardship criteria as defined by Paragraph 1565 (of German federal law)," the daily Frankfurter Rundschau quoted the judge's letter as saying. It must be taken into account, the judge argued, that both man and wife have Moroccan backgrounds.
The decision boils down to this:
- If a non-Muslim man beats, and threatens to murder, his wife, then the wife has a "right" to ask for an immediate divorce.
- If a Muslim man exercises his "right" to beat his wife and threaten her with murder, then the wife is essentially screwed.
According to the judge, "justice" is now dependent on one's religious background. In this case, what a non-entity said to a pathological Arab fourteen hundred years ago determines whether a Muslim woman should get a quick divorce or not...in Germany.
By the way, don't forget: Islam respects women!

If the German government is not prepared to spell out exactly what services, laws, protections and treatments apply to Muslims verses non Muslims then all German laws should be considered null and void. As such, Germany is a nation without rule of law and in my opinion, a failed state. Either that or Sharia, being the only functional legal system should be applied universally. Let Germans and European visitors to Germany experience that for a few years and report back on how it worked out.

The lawyer and her client were shocked. Immediately, they filed a claim alleging that the judge should have recused herself due to a conflict of interest. They felt that, because of the point of view presented by the judge, she was unable to reach an objective verdict. In the reply sent to Becker-Rojczyk, the judge expressly referred to a Koran verse -- or sura -- which indicates that a man's honor is injured when his wife behaves in an unchaste manner. "Apparently the judge deems it unchaste when my client adapts a Western lifestyle," Becker-Rojczyk said.
So, the Judge is a female (Muslim, I assume) who thought the wife had it coming for acting western.

On second thought the Judge probably isn't a Muslim, whith a name like Christa Datz-Winter.
Note this article says "While the Quranic verse cited does say that husbands are allowed to beat their wives if they are disobedient, Germany's Institute for Islamic Questions noted that such an interpretation was no longer standard."
Really? I thought the standard, to the extent there is one, is now is "light beating."
Are Muslims beginning to repudiate the Koran on this?
Better things in this article:
Note, I got that like from this blog which baldly states that the Judges fault was that she's ignorant of Islam. But they don't back that up at all.

Being the author of that blog, would you like me to give you a full, researched view of the issue of domestic violence from a shari` point of view? Most readers of Islamosphere would quickly recognise the judge was completely out of line, but I'd be more than happy to oblige.

Glad to see that senior German politicians have taken this up, and that it is highlighting the absurdities of Multiculturalism in Europe. A judge who cannot see the direct conflict between the Koran and the German Law that she is supposed to be administering should be struck off - she is no "judge" at all.

Mr. Yasmin, here is a sermon from Qatar TV proclaiming that wife beating is Islamic and "a wonderous thing".
Here is a disturbing transcript to an even more disturbing video of a Saudi TV host and (in the scary second half) with her abusive husband.
It's clear from the interview:
1. the poor woman will be an abused prisoner in her house from now on (and no longer allowed her job etc).
2. the husband went slightly further than Saudis approve of, since he hit her in the face, and threatened to kill her.
3. no one is disputing his right to beat his wife, and he feels no shame in that.
4. it demonstrates what sort of life giving women an inferior, subservient position leads to.
And I know this is a Christian vs. Islam web site, but it critisizes Islam's claims about wife beating in detail. If you answer that article paragraph by paragraph I will be interested in reading your answer. I say paragraph by paragraph because the usual sort of arguement is one where the defender of Islam simply ignores every salient point. That's no arguement, it's just the appearance of one.
